PROCEEDINGS AT

ARRAIGNMENT HEARING

APPEARANCES:

Chandra C. Fisher for the Crown

Christopher W.A. Brennan for the accused Cerny

Proceedings

10 December 2000
Victoria, B.C.

THE CLERK: Recalling number 37, a federal matter, Jerry-Lee Joan Cherry, information -- sorry, Cerny, information 112479.

MR. BRENNAN: Your Honour, my name is Christopher Brennan and I'm appearing as out-of-custody duty counsel with -- with this young woman.
This was a matter with -- that was before His Honour Judge Smith a little bit earlier and it sort of started to come a little bit off the tracks with a co-accused and an agent who was attempting to represent various people in relation to identical matters. I think that I have instructions that would probably lead to a resolution of the matter, but from a point of view of convenience for my friend and, I suppose, Ms. Cerny, I'm going to ask that this matter now be brought forward to be adjourned to the 20th of this month, that's Wednesday, at two o'clock in this court, and as I say, that's with a view to resolving the -- the matter.
I think it was adjourned to the 2nd of January in relation to both of them, but my understanding is that Ms. Cerny would like to more or less split the [indiscernible/speakers overlapping].

THE COURT: Spread things apart, eh?

MS. FISHER: It's agreeable, Your Honour.

THE COURT: Agreeable? That is to the 20th of December, ma'am, at nine-thirty here. Thank you.

MR. BRENNAN: Very good. Thank you, Your Honour.

THE COURT: Thank you, Mr. Brennan.

THE CLERK: Do you want two o'clock?

MR. BRENNAN: Okay.

THE CLERK: I think they wanted two o'clock, Your Honour.

MS. FISHER: Mr. Brennan, did you want two o'clock?

THE COURT: Is that two o'clock?

MR. BRENNAN: Two o'clock.

THE COURT: Because I had said nine-thirty.

MR. BRENNAN: Very good.

THE COURT: So, that is two o'clock.

MR. BRENNAN: Two o'clock.

THE COURT: Thank you.
